1. Who we are and what these Terms cover
These Terms and Conditions ("Terms") govern your access to and use of the websites, client portal, partner portal, documents and communications (together, the "Services") of G73 Capital Limited, a company incorporated in Hong Kong (Company No. 80724707) ("G73", "we", "us"). Operations are conducted from the United Arab Emirates; access for EU-based investors is arranged through an AFM-regulated entity in the Netherlands. By creating an account, ticking an acceptance box, or continuing to use the Services, you agree to be bound by these Terms, our Privacy Policy and, where applicable, the Limited Power of Attorney & Trading Authorisation.
2. Nature of the service — no advice, no solicitation
G73 acts as a trading strategy manager within PAMM structures operated by third-party regulated brokers. The Services are provided by personal introduction only and constitute neither an offer of securities, nor investment advice, nor portfolio management or advisory services within the meaning of any applicable regulation. Nothing on the site, in the portal, in reports or in any communication from G73 is a recommendation to invest. Any decision to allocate capital is made solely by you, at your own risk, on the basis of your own assessment.
3. Custody and the broker relationship
Your capital is at all times held in your own account with the third-party broker. G73 never receives, holds, pools or transmits client money. Deposits, withdrawals and participation in any PAMM structure are executed exclusively between you and the broker under the broker's own agreements, including the broker's PAMM service agreement which you accept directly with the broker. G73 is not a party to, and assumes no responsibility for, the broker's services, solvency, execution quality or regulatory status.
4. Eligibility and your representations
- You are at least 18 years old and have full legal capacity;
- you meet all requirements of the securities, derivatives, tax and civil law of your jurisdiction of residence, and your use of the Services does not violate any law applicable to you;
- all information you provide to us is true, accurate and kept up to date;
- you understand leveraged trading in FX, CFDs, metals and digital assets, and you are financially able to bear the total loss of the capital you allocate;
- you are acting for your own account and not for any undisclosed third party.
5. Risk disclosure
Trading leveraged derivatives and digital assets carries a high level of risk and can result in the loss of your entire investment. Past performance, including independently verified track records, is not indicative of future results. Returns are variable and not guaranteed. Performance figures are presented gross of fees unless stated otherwise. You should not allocate capital you cannot afford to lose. In months without new net profit above the previous high-water mark, no performance fee is charged; this does not imply capital protection of any kind.
6. Fees
Fees are defined in the PAMM offer you accept at the broker (performance fee on a monthly high-water-mark basis, and any deposit, withdrawal or management fees stated in the offer). Fee calculation and collection are performed by the broker's PAMM system, not by G73 directly. The applicable offer parameters prevail over any general description on the site.
7. Portal accounts
Portal access is personal and non-transferable. You are responsible for keeping your credentials confidential and for all activity under your account. We may suspend or terminate access at any time where we reasonably suspect misuse, unlawful conduct, or breach of these Terms. Complaints regarding unauthorised access will be rejected where access logs show that your valid credentials were used.
8. Reporting and data
Performance data shown in the Services is derived from broker and third-party feeds (including independent verification services) and is provided for information only. While we take care to present accurate data, feeds may be delayed, revised or interrupted, and the broker's own records prevail in any discrepancy. Weekly letters and dashboards are informational and do not constitute account statements.
9. Intellectual property
The site, portal, documents, brand, logo and materials are the property of G73 or its licensors. You may not reproduce, distribute or create derivative works without our prior written consent, except for materials expressly provided to you for sharing under a partner arrangement.
10. Limitation of liability
To the maximum extent permitted by law: (a) G73, its directors, officers, employees and agents shall not be liable for trading losses, loss of profit, loss of opportunity, or any indirect, incidental, special or consequential loss arising out of or in connection with the Services; (b) nothing in these Terms excludes liability for fraud or for any liability that cannot lawfully be excluded; (c) our aggregate liability arising out of or in connection with the Services shall in any event be limited to the total performance fees actually received by G73 that are attributable to your participation during the twelve (12) months preceding the event giving rise to the claim.
11. Indemnity
You agree to indemnify and hold harmless G73, its directors, officers, employees and agents against all liabilities, losses, costs, claims and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of applicable law, or instructions given from your account.
12. Force majeure
G73 shall not be liable for partial or non-performance caused by events beyond its reasonable control, including market suspension or closure, broker default or outage, communications or systems failure, acts of government or regulators, or changes in law.
13. Amendments
We may amend these Terms by publishing an updated version with a new version date and, where the change is material, asking you to re-accept on your next portal sign-in. Continued use of the Services after publication constitutes acceptance.
14. Severability and assignment
If any provision of these Terms is held invalid, the remainder continues in force. You may not assign your rights under these Terms; we may assign to an affiliate or successor of the business on notice to you.
15. Governing law and dispute resolution
These Terms, and any dispute or claim (including non-contractual disputes) arising out of or in connection with them, are governed by the laws of the Hong Kong Special Administrative Region. Any dispute shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted; the seat shall be Hong Kong, the tribunal shall consist of one arbitrator, and the language shall be English. To the extent permitted by law, each party waives any right to participate in class or collective proceedings.
